A Georgia man is in the hospital after he was shot while assaulting his girlfriend, the shooter? The girl’s father.

Habersham County Sheriffs were called out to a home after reports of a shooting. When authorities arrived they found a 26-year old man with a gunshot wound to his abdomen. The shooter, 55-year old Cory Merchant surrendered and was taken into custody.

Investigators would soon discover, after interviewing Merchant and his daughter who was also at the scene, that the 55-year old merchant shot the 26-year old in defense of his daughter. Investigators discovered that the 26-year old man had repeatedly assaulted his girlfriend, Merchant’s daughter,  and Merchant shot him as a means of getting him to stop.

Lt. Kogod of the Habersham Sheriff’s Department told Now Habersham “we ended up not charging him because his actions did not constitute a criminal act,” in reference to Merchant’s initially being charged. The 26-year old man on the other hand, was charged with a whole series of crimes including false imprisonment, third-degree cruelty to children, and aggravated assault.

Cory Merchant used his 2nd Amendment rights to protect his young daughter from domestic abuse. Generally when we see cases of self-defense it is just that plain as day, someone is using a firearm to defend themselves, but in this case we get to see someone protect someone else.
